1. Agreement
These Terms of Use ("Terms") are a legal agreement between you and Elvara Health Inc. ("Elvara," "we," "us"). By accessing our website, joining the private beta, or using the Elvara app (together, the "Service"), you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
2. Eligibility
You must be at least 18 years old to use the Service. The beta currently runs on iPhone via Apple TestFlight and is open to residents of the United States and Canada. By using the Service you confirm you meet these requirements and that the information you provide is accurate.
3. The private beta
Elvara is in active development and is offered to beta participants free of charge. You understand and agree that:
- The Service is provided on an "as is" and "as available" basis and may contain bugs, errors, or incomplete features.
- Features, content, and availability may change, be suspended, or be discontinued at any time without notice.
- We may add, modify, or end the beta, or remove participants, at our discretion.
- We do not guarantee uninterrupted access, specific results, or that any data you enter will be preserved.
4. Your responsibilities
You agree to use the Service only for lawful, personal, non-commercial purposes; to keep your login details secure; and not to misuse, copy, reverse-engineer, resell, or attempt to disrupt the Service. You're responsible for the accuracy of the information you provide (including any health-related details you choose to share).
5. Feedback
We'd love your honest feedback. By sharing feedback, suggestions, or ideas about the Service, you grant us a perpetual, worldwide, royalty-free license to use them to improve and develop Elvara, without obligation or compensation to you.
6. Intellectual property
The Service, including its software, content, designs, and the Elvara name and branding, is owned by Elvara and protected by law. We grant you a limited, personal, non-transferable, revocable license to use the Service during the beta. You retain ownership of the personal data and content you provide.
7. Not medical advice
Elvara provides general fitness and training information and coaching — it is not medical advice, diagnosis, or treatment, and it is not a substitute for professional medical care. We are not doctors, physiotherapists, dietitians, or licensed healthcare providers, and using the Service does not create a clinical relationship.
You should consult a qualified healthcare professional before starting, changing, or stopping any exercise or nutrition program — and especially if you are pregnant or postpartum, perimenopausal or menopausal, taking hormone therapy (HRT), using a GLP-1 or other weight-loss or prescription medication, recovering from injury, or living with any medical condition. Elvara does not manage, advise on, or interact with your medications or medical treatment; always follow the guidance of your own healthcare providers. If you experience pain, dizziness, or any concerning symptoms, stop and seek medical attention.
8. Assumption of risk
Physical exercise carries inherent risks, including injury. You participate voluntarily and assume full responsibility for your choices and any resulting injury, loss, or damage. You confirm you are medically able to exercise, and you will adapt or stop activity as your body requires.
9. Health data and privacy
How we collect, use, and protect your information — including health-related information you choose to share — is described in our Privacy Policy. By using the Service you consent to those practices.
10. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be error-free, secure, or produce particular results.
11. Limitation of liability
To the fullest extent permitted by law, Elvara and its team will not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your use of (or inability to use) the Service, including any injury or health outcome. Where liability cannot be excluded, it is limited to the amount you paid us for the Service (which, during the free beta, is zero).
12. Termination
You may stop using the Service at any time. We may suspend or end your access at any time, including at the end of the beta. Sections that by their nature should survive (e.g., intellectual property, disclaimers, limitation of liability) will survive termination.
13. Changes to these Terms
We may update these Terms as the product evolves. Material changes will be communicated through the Service or by email. Continued use after changes means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of its courts.
